1. Acceptance of Terms

By accessing or using AIMeInfluencer ("the Platform"), you agree to be bound by these Terms of Service, our Privacy Policy, Responsible AI Policy, and Security Policy. If you do not agree, do not use the Platform.

2. Description of Service

AIMeInfluencer is an AI-powered social media creative and publishing platform that enables users to generate marketing campaigns, create storyboards, produce image and video assets, and schedule and publish content to third-party social media platforms including TikTok, Instagram, YouTube, Facebook, and X (formerly Twitter).

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Platform. If you use the Platform on behalf of a company or other organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized account access.

5. Acceptable Use

You agree not to use the Platform to:

  • Upload, generate, or publish content that is illegal, harmful, hateful, harassing, defamatory, obscene, or otherwise objectionable.
  • Infringe any third-party intellectual property, trademark, copyright, or other proprietary rights.
  • Engage in unauthorized scraping, data mining, or automated access to the Platform.
  • Interfere with the operation of the Platform or circumvent security controls.
  • Use AI-generated content to deceive, defraud, or impersonate real individuals without consent.

6. Creator IP and Uploaded Content

6.1 Your Ownership

You retain all intellectual property rights in content you upload to the Platform ("User Content"), including images, logos, product photos, music tracks, and other assets.

6.2 Your Representations

By uploading any content, you represent and warrant that:

  • You own the content or have a valid license, permission, or legal right to use it.
  • The content does not infringe any copyright, trademark, right of publicity, or other intellectual property right.
  • The content complies with our Content Policy (Section 5) and does not violate applicable law.
  • You have obtained any required consents from individuals depicted in the content.

6.3 License to Platform

By uploading User Content, you grant AIMeCreations LLC a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process your content solely for the purpose of operating the Platform and delivering services to you.

6.4 Consent at Upload

The Platform requires you to confirm IP ownership and content policy compliance at the time of each upload. This confirmation is logged and associated with your account for audit purposes. Providing false confirmations may result in account suspension and legal liability.

7. Music Licensing

Music tracks you upload must be tracks you own, have licensed for commercial use, or are otherwise permitted to use in published social media content. You acknowledge that:

  • Uploading music you do not have the right to use may result in content takedowns by third-party platforms.
  • AIMeCreations LLC is not responsible for copyright claims filed by music rights holders against content you publish.
  • You must confirm music rights at the time of upload.

8. AI-Generated Marketing Content

8.1 Nature of AI Output

The Platform uses artificial intelligence to generate campaign ideas, captions, hooks, storyboards, and other marketing content. AI-generated content is provided as a creative starting point and may contain inaccuracies, inconsistencies, or content that requires human review before publication.

8.2 Your Responsibility

You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing. AIMeCreations LLC is not liable for claims arising from the publication of AI-generated content that you have not properly reviewed.

8.3 No Professional Advice

AI-generated content does not constitute legal, financial, medical, or professional advice.

9. Publishing to Third-Party Platforms

When you connect social media accounts and authorize the Platform to publish on your behalf:

  • You must comply with the terms of service of each third-party platform (TikTok, Instagram, YouTube, Facebook, X).
  • You grant the Platform permission to post content using your connected credentials.
  • AIMeCreations LLC is not liable for the removal, suspension, or penalties applied by third-party platforms to your accounts.
  • Publishing credentials are stored securely and used only for authorized publishing operations.

10. Business Client Content

If you use the Platform to create and publish content on behalf of a business or client, you represent that you have the authority and all necessary permissions from that business or client to do so.

11. Content Moderation

The Platform performs automated content moderation on uploaded images using AI moderation systems. Content that is flagged as potentially violating our Content Policy may be rejected. You may contact support for manual review of moderation decisions.

12. Intellectual Property of the Platform

All Platform software, interfaces, AI models, templates, and proprietary tools are owned by AIMeCreations LLC or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Platform.

13. Termination

We reserve the right to suspend or terminate your account for violation of these Terms, applicable law, or at our discretion with reasonable notice. You may delete your account at any time.

14. Disclaimers

The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free AI output, or successful publication to third-party platforms.

15. Limitation of Liability

To the maximum extent permitted by law, AIMeCreations LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

17. Changes to Terms

We may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms. We will notify you of material changes via email or in-platform notice.
